I do not listen to Rush Limbo.Its bad enough he is a junkie,but to sit there and take the ACLU's help just made him a hypocrite.He did not need a free lawyer and even if he was too cheap to get his own lawyer I am sure there are lots of lawyer dittoheads out there who would have done his case for free.

Last I heard the DA was trying to subpena his entire medical record so they could go fishing to see if Rush committed a crime. The ACLU had to pick it up because of the precident that would have set; that the DA can go fishing in your medical records with out first providing probable cause to a judge to obtain a warent for your records.
As I understand it, the DA lost their request, could not prove any wrong doing as they had no evidence, and the whole legal issue went away.
If you could provide a link to any pending legal action, if there is any, that would be helpfull, but as for a conviction.....there was never even an inditement.
As for drug addicts per-se, IMO punishing confessed addics of illegal or controled substances who then enter rehab on their own and remain clean there after, like Rush, would only serve to keep addicts from comming out and getting help.

As to the legal issue, you are correect, DAs cannot be allowed to use the power of a subpoena to conduct a fishing expedition.
No cause, no warrant.... NO EXCEPTIONS!
This case was handled properly and that is that!!!

Besides the negative publicity and legal troubles, his wife divorced him shortly after the scandal broke. |
