Because the Constitution was set up to say that there are certain things that are so fundamental that they should not be put to the whim of the voters. If you studied Constitutional Law you would know that the Constitution exists to prevent the tyranny of the majority over the minority.
If not.....why not put everything to a vote, such as:
1. The right of inter-racial marriage
2. The right of women to vote
3. What qualifies as "speech" under the first Amendment
4. What qualifies as "arms" under the second Amendment
5. Which groups are entitled to free assembly
6. What publications are entitled to freedom of the press
7. What religious groups should be allowed to practice their religion
etc.....
